KNVEX — TERMS & CONDITIONS

1. NATURE AND PURPOSE OF KNVEX

KNVEX is a digital discovery, listing, and connection platform intended to help users discover and contact other users regarding equipment, machinery, agricultural equipment, vehicles, tools, services, event equipment, and other permitted listings.

The primary role of KNVEX is to provide a digital platform through which one user may discover information and contact another user. KNVEX does not guarantee that any user will receive a lead, enquiry, customer, rental booking, sale, hire, income, profit, response, or completed transaction through the Platform.

The availability of a listing or contact information on KNVEX does not constitute a promise or guarantee that:

• the listed equipment is available;
• the listed service is available;
• the listed price is current;
• the listing owner will respond;
• the user will receive a lead;
• the parties will reach an agreement;
• a transaction will take place; or
• the transaction will be successful.

2. KNVEX'S LIMITED ROLE

To the maximum extent permitted by applicable law, KNVEX acts as a technology platform that facilitates discovery and communication between users. KNVEX is not:

• the owner of listed machinery;
• the seller of listed goods;
• the renter or hirer;
• the service provider;
• the manufacturer;
• the purchaser or buyer;
• an agent;
• a broker;
• an auctioneer;
• a guarantor;
• an insurer;
• an escrow service;
• a payment intermediary.

Unless expressly stated otherwise, KNVEX does not become a party to any transaction, rental, lease, sale, hiring arrangement, service agreement, payment arrangement, or other contract between users.

3. INTERMEDIARY STATUS

Where the applicable legal requirements are satisfied, KNVEX may seek the benefit of intermediary safe-harbour protections available under applicable Indian law, including Section 79 of the Information Technology Act, 2000.

Section 79 provides exemption from liability for certain third-party information, data, or communication links subject to statutory conditions and due diligence requirements.

KNVEX does not claim immunity from liability for its own unlawful acts, contractual obligations, statutory duties, or circumstances where applicable law does not provide such protection. KNVEX will take such measures as are required by applicable law and applicable intermediary due-diligence requirements.

4. USER-TO-USER RELATIONSHIP

Users understand that interactions initiated through KNVEX are between the relevant users. A user may:

• view a listing;
• contact a listing owner;
• exchange contact info;
• physically meet;
• inspect equipment;
• negotiate a price;
• negotiate rental terms;
• enter into an agreement;
• decide not to proceed.

KNVEX is not a party to these interactions unless expressly stated otherwise. Any agreement between users is an independent agreement between those users.

5. NO GUARANTEE OF LEADS OR BUSINESS

KNVEX does not guarantee any minimum number of:

• leads;
• calls;
• enquiries;
• messages;
• customers;
• rentals;
• bookings;
• sales;
• hires;
• views;
• impressions;
• responses.

Listing your equipment or service on KNVEX does not guarantee that another person will contact you. No user shall treat the Platform as providing a guaranteed business opportunity.

6. LISTING ACCURACY AND USER RESPONSIBILITY

Every listing is created or supplied by the relevant user. The listing owner is solely responsible for ensuring that the information provided is accurate, complete, current, lawful, and not misleading. This includes responsibility for:

• ownership;
• authorization;
• equipment condition;
• specifications;
• availability & price;
• location & contact;
• legal permissions;
• licences & insurance;
• fitness for purpose;
• user representations.

7. NO OWNERSHIP OR QUALITY VERIFICATION

Unless expressly stated otherwise for a particular feature, KNVEX does not physically inspect or independently verify:

• ownership;
• possession;
• owner identity;
• machinery condition;
• mechanical fitness;
• maintenance history;
• insurance;
• licences;
• permits;
• pricing;
• user claims.

8. USER VERIFICATION AND DUE DILIGENCE

Before dealing with another user, users are strongly advised to independently verify:

• identity & ownership;
• authority to rent/sell;
• equipment condition;
• documents & registration;
• insurance, licences & permits;
• price & availability;
• location & rental duration;
• security deposit & terms;
• damage responsibility;
• other applicable conditions.

9. OFFLINE MEETINGS AND TRANSACTIONS

Users may choose to meet physically after discovering each other through KNVEX. Any physical meeting is undertaken at the users' own discretion and risk, subject to applicable law. KNVEX does not control:

• where and when users meet;
• what users discuss or inspect;
• whether users enter into an agreement; or
• whether any payment is made.

Users should take reasonable safety precautions when meeting people they first encountered online.

10. PAYMENTS, ADVANCE MONEY AND RENTAL AMOUNTS

Unless expressly stated otherwise, KNVEX does not collect, hold, transfer, guarantee, or escrow money relating to transactions between users. KNVEX is not responsible for:

• advance payments;
• rental payments;
• refunds or unpaid rent;
• cancellation fees;
• damages;
• cash transfers;
• UPI payments.

11. NO GUARANTEE OF TRANSACTION

KNVEX does not guarantee that:

• the listing owner will accept an enquiry;
• the customer will hire or purchase;
• the equipment or service will be available;
• the agreed price will remain unchanged;
• the parties will honor their agreement;
• payment will be made or refunded;
• the equipment will work properly; or
• the transaction will be completed.

12. EQUIPMENT DAMAGE, BREAKDOWN, LOSS AND THEFT

KNVEX does not take possession or operational control of equipment listed by users. Accordingly, KNVEX is not responsible for disputes concerning:

• machinery breakdown;
• accidental damage;
• theft or loss;
• improper operation;
• maintenance or fuel;
• repair expenses;
• downtime;
• loss of income;
• replacement costs.

13. ACCIDENTS, INJURY AND PROPERTY DAMAGE

Users are solely responsible for operating or using equipment safely and lawfully. To the maximum extent permitted by applicable law, KNVEX is not responsible for claims arising from personal injury, death, accidents, property damage, or other physical events occurring during a user-to-user transaction.

14. SERVICE QUALITY

Where a user lists a service, the service provider is solely responsible for:

• performing the service;
• quality & timelines;
• pricing & staff;
• licences;
• safety & warranties;
• legal compliance.

15. USER CONDUCT

Users must not use KNVEX to:

• commit fraud or impersonate others;
• publish false listings;
• advertise unauthorized equipment;
• manipulate prices deceptively;
• harass or threaten other users;
• publish unlawful material;
• infringe intellectual-property;
• collect data without authorization;
• distribute malware;
• scrape Platform data;
• use bots or automated systems;
• create fake accounts;
• conduct illegal activities.

16. FRAUD, SCAMS AND SUSPICIOUS ACTIVITY

KNVEX may suspend, restrict, remove, or terminate accounts or listings where it reasonably believes that a user is engaging in fraud, misleading other users, operating fake listings, or violating these Terms.

17. USER-GENERATED CONTENT

Users retain their rights in content they lawfully own and submit. By submitting, you grant KNVEX a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that content for Platform operation and promotion.

18. INTELLECTUAL PROPERTY OF KNVEX

KNVEX owns or has lawful rights to use its:

• name, logo & branding;
• software & source code;
• UI & visual design;
• graphics & databases;
• original content;
• search algorithms;
• Platform architecture;
• proprietary materials.

19. LISTING REMOVAL AND ACCOUNT SUSPENSION

KNVEX may remove, restrict, hide, or disable a listing or account for violations of Terms, suspected fraud, unlawful content, or user complaints. Action may be immediate to protect the Platform.

20. CONTENT MODERATION AND LEGAL REMOVAL

KNVEX may review and remove access to content in accordance with court orders, government directions, or intermediary due-diligence obligations under Indian law.

21. GRIEVANCE REDRESSAL

KNVEX maintains the grievance mechanism required by applicable law:

To the maximum extent permitted by applicable law, KNVEX and its operators will not be responsible for:

• fake listings;
• fraud or scams;
• failure to pay;
• cancelled deals;
• breakdown;
• theft;
• personal injury;
• service failure;
• loss of profits;
• expected leads;
• indirect losses.

27. USER INDEMNIFICATION

You agree to indemnify and hold harmless KNVEX from claims arising from your violation of these Terms, unlawful conduct, or your transaction with another user.
